Terms of Service

1. About these terms

These Terms of Service govern your use of CommandPost AI at commandpostai.net, operated by Brian Pitts. By using the service, you agree to these terms. If you use it for an organization, you must have authority to act for that organization. You must be at least 18 years old. Questions, billing concerns, and notices can be sent to Briancpitts39@gmail.com.

2. Accounts and workspace access

Provide accurate information, protect your sign-in and connected accounts, and promptly report unauthorized activity. You are responsible for the members, workers, permissions, instructions, and integrations you authorize in your workspace. Do not share authentication codes or provider secrets in prompts. We may verify access, limit abusive usage, or suspend an account when reasonably needed to protect the service or comply with law.

3. AI workers and approvals

The service helps prepare content, manage assignments, schedule posts, and support email, inbox, and phone workflows where available and configured. Workers act within configured permissions and approval rules. Review those settings before activation. You remain responsible for the content, recipients, timing, privacy settings, claims, and actions you authorize. AI can make mistakes, omit facts, or produce similar outputs for different users. Verify outputs before relying on them. The service does not provide professional legal, medical, tax, or financial advice and is not an emergency service.

4. Content ownership and permission

You retain your rights in the content you provide. You grant us permission to store, process, transform, and transmit it only as needed to provide, secure, and support the service and carry out your instructions, including through applicable service providers. You must have the rights and permissions required for uploaded media, brands, likenesses, music, customer information, and communications. Rights in generated outputs are subject to applicable law and provider terms; we do not guarantee originality, exclusivity, copyright protection, or freedom from third-party claims.

5. Connected platforms and communications

Connections require your authorization and may be affected by provider approvals, permissions, API limits, outages, and policy changes. A successful scheduling request is not a guarantee of delivery or publication. Check processing status and the destination account. Email campaigns and phone workflows require appropriate recipient permissions, sender identification, opt-out handling, and compliance with applicable communications rules. If recording, transcribing, or using an AI voice, provide required notices and obtain required consent. Do not use the service for unsolicited spam, impersonation, deceptive calls, or emergency response.

6. Subscriptions and payment

The plan, price, billing interval, included allowance, and any usage charges are shown before purchase. Recurring subscriptions renew at the disclosed interval until canceled. Where a trial or test mode is offered, its stated limits apply; sandbox purchases and credits do not represent a live payment or fund real vendor usage. Stripe processes payments. Taxes or additional charges apply only as disclosed or required. We may pause paid features for failed payments or exhausted balances. Future price changes will be communicated before they take effect where required.

7. Credits and usage charges

CommandPost AI credits are prepaid units for eligible service usage, not currency, deposits, or ownership in a vendor account. Different actions consume different amounts, as displayed in the product. Included subscription credits expire at the applicable billing-period end. Purchased extra credits carry forward and currently require an active subscription to spend; they are separate from vendor credits. There is no automatic credit recharge unless you separately authorize one. A request can reserve credits before processing. Confirmed provider failures may release or refund credits; an uncertain request may require review to avoid duplicate usage. Contact us about disputed deductions. Credits have no cash-redemption right except as required by law or an approved refund.

8. Cancellation and refunds

You can manage or cancel a supported paid subscription through the billing portal linked from Pricing. If that is unavailable, email us for assistance. Cancellation stops future renewals once effective; check the confirmation for your access end date. Canceling a subscription does not automatically erase workspace data or reverse completed usage. Refund requests are reviewed based on the payment, usage, service issue, and applicable consumer rights. Nothing here limits refunds or cancellation rights required by law. Do not assume that unused credits or a partially used billing period will be refunded automatically.

9. Acceptable use

Do not use the service for unlawful, infringing, fraudulent, harassing, discriminatory, exploitative, or deceptive activity; malware; unauthorized surveillance; account compromise; artificial engagement; or attempts to evade provider restrictions. Do not target children under 13 or the applicable age of digital consent. Do not submit protected health information or payment-card data outside the third-party payment processor. Comply with applicable platform and AI-provider policies. We may remove prohibited material or restrict access when reasonably necessary, with notice where appropriate.

10. Availability and limits of responsibility

We work to maintain the service but cannot promise uninterrupted access, a particular business result, successful publication, or error-free AI output. To the extent permitted by law, the service is provided as available without warranties of merchantability, fitness for a particular purpose, or noninfringement. To that same extent, we are not responsible for indirect or consequential losses such as lost profits, and our aggregate liability for service-related claims is limited to the fees you paid us during the 12 months before the event giving rise to the claim. These limits do not exclude liability that cannot lawfully be excluded or restrict mandatory consumer rights.

11. Ending service, changes, and disputes

You may stop using the service and request account deletion. We may end or restrict service for material misuse, nonpayment, legal requirements, or discontinuation, providing notice and a reasonable opportunity to retrieve available data where practicable. We will post updated terms with a revised date and give additional notice of material changes where required. Contact us first so we can try to resolve a dispute. Applicable law and courts with lawful jurisdiction govern disputes; these terms do not require binding arbitration or waive rights that cannot legally be waived.
